Terms of Use for users of the database for seals and KITAS serialnumbers VDO SealBase (in the following "Terms of use")

Section 1: General description of the database VDO SealBase

Thank you for using our SealBase database. The database is made available to you by Continental Automotive Technologies GmbH (hereinafter referred to as "Continental").

The SealBase database helps you meet the legal requirements for documentation of tachograph seal receivers and KITAS speed sensors. The identification is carried out by means of the respective serial number. The serial numbers of the tachograph seals can be entered individually or as a sequence of numbers (from start serial number to end serial number).

The serial number can be used to check where a seal/KITAS speed sensor has been delivered to if it has been passed on/installed by you

Section 2: Using of the database VDO SealBase

The use of the SealBase database requires the following:

  • You have logged in with your email address and password.
  • You have agreed to the terms of use, which you should read carefully beforehand.
You are obliged to provide truthful information when registering and notify Continental immediately of any subsequent changes.

2. Security in handling the database VDO SealBase
After each use, the VDO SealBase database must be left via "Logout". If you have become aware that third parties are misusing your user data, you must notify Continental immediately in writing, possibly in advance by e-mail.

Please keep your password confidential to protect your access. You are responsible for the activities in and with the access. If possible, do not use the password of your access also for offers of third parties

You can request the deletion of your access at any time in writing, provided that the processing of ongoing contractual relationships or statutory provisions do not conflict with this deletion. Continental will delete all user data and all other stored personal data of the user. You can find further information on the handling of your personal data when using SealBase in our footer "Datenschutz".

3. Using SealBase
To enter/check serial numbers of seals or KITAS speed sensors you must be logged in.

You will receive access via a license letter (WorkshopTab 4.0 License). On this letter you will find an internet link. With this link you can register yourself. This will send you a mail with your access data.

Operation:

Once you have logged in to the tool you can immediately see which serial numbers of seals or KITAS speed sensors have already been registered to your account.

In addition, you can use this tool to make individual and collective recordings of serial numbers of seals or KITAS speed sensors.

4. No abusive use of the platform VDO SealBase
Do not use the VDO Sealbase registration platform in an abusive way. For example, you are not authorized to interfere with the platform or access the VDO Sealbase registration platform in any way other than via the user interface provided by Continental and in accordance with our instructions.

The VDO Sealbase registration platform registers serial numbers of seals or KITAS speed sensors installed or sold by authorized dealers or workshops. Registration is the sole responsibility of the respective workshop/distributor. Continental does not make these its own. Continental reserves the right to review content for illegality or violations of policy. We may remove or refuse to display content that we reasonably believe to be in violation of our policies or applicable law.

Section 3: Amending the terms of use

Continental may reasonably amend these terms of use or any additional conditions for VDO SealBase (e.g. to take account of changes to general legal conditions or changes to our offering), so make sure that you check these terms of use regularly. We will tell you about any amendments to these terms of use on this page.

We will tell you about any amendments to additional conditions within the relevant service itself. Amendments do not apply retroactively; instead, they shall not apply until 14 days at the earliest following their announcement. However, amendments made in response to a new function for a service or for legal reasons are effective immediately. If you do not agree to the amended terms of use for a service, you will no longer be able to use this service.

Section 4: Liability

The information provided on the online database about any products and services made available can be changed or updated at any time by Continental without prior notice. The platform does not contain any guarantees or statements of quality for which Continental is liable, whether expressly or implicitly. Similarly, Continental makes no guarantee that the information provided is up-to-date, correct or complete and assumes no responsibility for its quality. The user shall not manipulate the database and shall use it only as intended.

Claims by the user for compensation for damages that may arise in relation to the use of the database and its content are excluded. This exclusion does not include claims for compensation of damages arising from injury to life, limb or health or the liability for other damages that are attributed to a willful or grossly negligent breach of a duty by Continental, its legal representatives or vicarious agents. In the event of a breach of material contractual obligations, Continental is only liable for the foreseeable and direct loss typical of this type of contract when this loss has been caused by simple negligence. Material contractual obligations are those that necessarily have to be fulfilled in order to achieve the object of a contract. These limitations of liability shall also apply to the benefit of the legal representatives and vicarious agents of Continental if claims are asserted directly against them. The regulations of the Produkthaftungsgesetz (German Product Liability Act) remain unaffected.

Section 5: Choice of law and place of jurisdiction

These terms of use are subject to the law of the Federal Republic of Germany under exclusion of the conflict of laws. The application of the United Nations Convention on Contracts for the International Sale of Goods of April 11, 1980 (UN Sales Convention) is excluded.

For all disputes arising from or associated with these terms of use, the sole place of jurisdiction shall be Hanover, Germany.

Section 6: Online settlement of disputes

Information concerning the online settlement of disputes can be found at the following link on the website of the European Commission: http://ec.europa.eu/consumers/odr/. This link is provided for information purposes only in accordance with Regulation (EU) No. 524/2013 of the European Parliament and of the Council. Continental is neither willing nor obligated to participate in dispute settlement proceedings before a consumer arbitration board.

Section 7: Severability clause

Should individual provisions of these terms of use prove to be invalid in full or in part, then the validity of the rest of the contract shall not be affected by that. The statutory provisions shall replace the invalid provision.
